The new Unified Patent Court (UPC) system in Europe has been described as a game-changer with respect to patent litigation, particularly when there are infringing activities in both Europe and the United States. By the time BIO 2025 takes place the Unified Patent Court will have reached its second anniversary. This session will discuss the most important UPC decisions so far and provide information on inter alia, the favourable UPC standards for granting preliminary and permanent injunctions, and strategies for preparing patent portfolios for UPC litigation. Additionally, the effects of the new system on licensing and co-ownership agreements will be addressed.
